These terms are an agreement between you and Sam Frings trading as Fallowing Space ("we", "us"), 6 Gregory Avenue, Mapperley, Nottingham, NG3 6BW, United Kingdom, and govern your purchase and use of the Fallowing Space software ("the software"). By buying or using the software you agree to them. Please read them alongside our Privacy policy.
We grant you a non-exclusive, non-transferable licence to use the software for a single practitioner's practice, for the period covered by your purchase. You may activate a standard single-practitioner licence on up to 3 devices (for example a desktop, a laptop and a tablet). On a multi-practitioner practice plan, each named practitioner may activate the software on up to 3 devices, up to the number of practitioners shown at checkout. Because your data is stored locally on each device, a practice plan provides a separate, private installation for each practitioner rather than a shared central record. You may not resell, rent, sub-licence, share or publish your licence key, and you may not copy, decompile or attempt to extract source code from the software except to the extent the law expressly allows.
We sell the software to you directly; card payments are taken on our behalf by Stripe. The price and billing period (monthly or annual) are shown at checkout, and that price is the total you pay unless VAT is separately shown. Subscriptions renew automatically at the end of each period unless you cancel before the renewal date. To cancel, contact us at contact [at] fallowing [dot] space, or use any self-service link shown on your receipt; cancellation stops future renewals, and your licence then runs to the end of the period you have already paid for.
At present we sell only to customers in the United Kingdom. If you are buying from elsewhere, please contact us first.
If you are a consumer in the UK, the Consumer Contracts Regulations 2013 normally give you 14 days to cancel an online purchase. Because Fallowing Space is digital content made available to you immediately, that statutory cancellation right ends once you begin using it, where at checkout you asked to start straight away and acknowledged that you would lose the right to cancel. Separately, and regardless of that, we offer a simple goodwill policy: if Fallowing Space isn't right for you, request a refund within 14 days of your first purchase and we will refund it in full. Renewal payments are not automatically refunded, but please contact us if something has gone wrong and we will try to put it right. Any refund is issued by us through Stripe to your original payment method.
The software stores your data locally on your device; we do not hold or back up your clients' data for you. You are responsible for: keeping regular backups using the export feature and storing them safely; safeguarding your device, your login and any encryption passphrase; and complying with your own professional, ethical and legal obligations as the controller of your clients' information. If you turn on at-rest encryption and lose your passphrase, your data cannot be recovered by anyone, including us. If you use the optional video feature, you are responsible for how you use that third-party service with your clients.
You agree to use the software lawfully and only for legitimate practice purposes, and not to misuse it, interfere with its operation, or use it in a way that infringes others' rights.
We may update the software from time to time to fix problems, improve it or reflect changes in the services it relies on. Some features depend on third parties (for example the optional video provider, and our payment and hosting providers); we don't control those services and can't guarantee they will always be available. We aim to give reasonable notice of significant changes.
The software, its design and its content are owned by us or our licensors and are protected by intellectual-property laws. These terms grant you a licence to use the software; they do not transfer any ownership to you. The records you create with the software remain yours.
The software is provided on an "as is" and "as available" basis. To the extent permitted by law, we make no warranties that it will be uninterrupted, error-free, or fit for a particular purpose. It is a tool to support your practice and does not provide clinical, legal or financial advice, and is not a substitute for your professional judgement.
Nothing in these terms limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, or for fraud), and nothing affects the statutory rights of consumers. Subject to that, to the maximum extent permitted by law we are not liable for loss of data, loss of profits or revenue, or any indirect or consequential loss arising from your use of or inability to use the software, and our total liability to you is limited to the amount you paid for the software in the [12] months before the claim. You are responsible for keeping backups.
Your licence ends when its period expires (if not renewed) or if you materially breach these terms. When the licence ends, you must stop using the software; your data remains on your device under your control, and you can continue to export it. We may end or suspend a licence where required by law or to prevent misuse.
We may update these terms; the current version is always the one on this page, with the date shown above. Where a change is significant we will tell licence holders by email. Continuing to use the software after a change means you accept the updated terms.
These terms are governed by the laws of England and Wales, and disputes are subject to the courts of England and Wales, without affecting any mandatory consumer-protection rights you have where you live.
