Fallowing Space is practice software for independent therapists, provided by Sam Frings trading as Fallowing Space ("we", "us"), 6 Gregory Avenue, Mapperley, Nottingham, NG3 6BW, United Kingdom. For anything in this policy you can contact us at contact [at] fallowing [dot] space.
This policy explains how we handle personal data in connection with our website and your licence to use the software. It is written under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
When you use the app, everything you enter — client records, session notes, treatment goals, uploaded and received documents, appointments, invoices and settings — is saved in your browser's local storage on the device you are using. This information is not transmitted to us, and we have no ability to read, copy or recover it.
Because your clients' information never reaches us, we do not act as your data processor for that information. You are the data controller for it, which means you are responsible for: safeguarding the device and keeping it secure; keeping your own backups using the export feature; and meeting your own professional, ethical and data-protection obligations to your clients. If you are a controller of clients' health information in the UK you will usually need to be registered with the Information Commissioner's Office (ICO) and to have your own privacy notice for your clients — that is separate from this policy.
Why we are allowed to handle it (legal bases). We process your purchase and licence data to perform our contract with you; support correspondence and security logging on the basis of our legitimate interests in running and protecting the service; and we keep sales records where the law (for example tax law) requires it.
If you choose to run a remote session using the built-in video, the live audio and video of that call are carried over the internet so that you and your client can see and hear each other. By default this uses Fallowing Space's own video service, which is included in your licence. For a one-to-one session the call connects directly between your device and your client's wherever the network allows; on networks that block a direct connection it relays through our video service so the call still works. Either way, the call is not recorded or stored, and your client records never pass through it — the only thing carried is the live call, and only while it is happening. This is the one part of the product where information about a session leaves your device, and it only happens when you actively start a video call. If you would rather not use Fallowing's service, you can configure your own self-hosted video server under Practice Admin → Your own video server, in which case the call runs on the server you control instead; you should then account for your hosting provider in your own privacy notice. If you prefer not to use video at all, simply don't use the feature.
We do not use advertising or cross-site tracking cookies, and the marketing site does not run third-party analytics. The app uses your browser's local storage (IndexedDB and session storage) purely to do its job — to hold your records on the device and to remember that you have unlocked the app during a session. This information stays in your browser; it is not sent to us.
The app offers optional safeguards you control: a passcode/second-factor app lock, encrypted backups, and at-rest encryption of your stored records using AES-256. Where you turn on at-rest encryption, your records are encrypted with a passphrase only you know. There is no passphrase recovery — if you lose it, your records cannot be recovered by us or anyone else, so keep it safe and keep backups. No method of storage is perfectly secure, and the security of your device and operating system remains your responsibility.
Some of our providers (for example Stripe and, if you use it, the video provider) may process data outside the UK and European Economic Area. Where they do, they are responsible for using a lawful transfer mechanism such as the UK International Data Transfer Agreement or equivalent safeguards.
We keep your purchase and licence records for as long as your licence is active and afterwards for as long as we are required to (for example for tax and accounting). Support emails are kept for as long as needed to help you and to keep a reasonable record. Your clients' data is kept by you, on your device, for as long as you choose.
You have rights over the personal data we hold about you, including to access it, to have it corrected or deleted, to object to or restrict certain processing, and to data portability. Some of these are limited by records we must keep (such as proof of sale). To exercise any of them, email contact [at] fallowing [dot] space. If you are unhappy with how we have handled your data you can complain to the ICO at ico.org.uk.
Fallowing Space is a professional tool sold to practitioners. It is not directed at or intended for purchase by anyone under 18.
If we change this policy we will update the date above and, where the change is significant, let licence holders know by email.
